1) Who We Are and What We Provide

Mistake To Mastery provides educational tools and content to help users study for exams (including the MCAT) and improve learning through practice, review, and analytics. The Service is for informational and educational purposes only.

2) Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may only use the Service with permission of a parent or legal guardian, who agrees to be responsible for your use.

3) Account Registration and Security

  • You may need to create an account to access features.
  • You agree to provide accurate information and keep it updated.
  • You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials.
  • Notify us immediately if you suspect unauthorized access.

4) Subscriptions, Payments, and Billing (If Applicable)

  • You authorize us (and our payment processor) to charge your payment method for subscription fees, taxes, and any other charges you incur.
  • Subscriptions may renew automatically unless you cancel before the renewal date.
  • Fees are generally non-refundable except where required by law or as explicitly stated at purchase.

5) Acceptable Use

  • Do not use the Service to break any law or regulation.
  • Do not upload, post, or share content that is illegal, harmful, harassing, threatening, or invasive of privacy.
  • Do not attempt to access or interfere with systems, accounts, or data you are not authorized to access.
  • Do not reverse engineer, scrape, or exploit the Service except where such restriction is prohibited by law.
  • Do not distribute malware, spam, or abusive content.

6) User Content and Copyright Rules (Very Important)

The Service may allow you to upload or submit content such as notes, prompts, text, images, documents, or other materials (“User Content”).

6.1 You Own What You Upload (and You’re Responsible for It)

  • You own the User Content you upload or you have all necessary rights, permissions, and licenses to upload and use it with the Service.
  • Your User Content does not infringe or misappropriate any third party’s intellectual property rights, privacy rights, or publicity rights.
  • If your User Content includes materials created by someone else, you have the right to use and upload them.

6.2 No Copyrighted Material Without Rights

Do not upload copyrighted or proprietary material unless you created it or have express permission or a valid license to use it. This includes copyrighted exam passages, questions, answer explanations, textbooks, study guides, videos, or images owned by third parties.

6.3 We Can Remove Content

We may review, remove, disable access to, or restrict User Content at any time if we believe it violates these Terms or applicable law.

6.4 Processing and Limited Retention of User Content

To provide the Service, your User Content may be processed and temporarily stored (for example, to generate outputs, display your work, maintain session state, prevent abuse, and debug issues). We do not intend to retain your User Content longer than necessary, but temporary storage, caching, and limited retention in backups, logs, or security systems may occur. Do not submit sensitive personal information.

6.5 License You Give Us to Operate the Service

You grant Mistake To Mastery a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, and display your User Content only as necessary to provide, maintain, secure, and improve the Service. This license ends when you delete your User Content, except for limited retention needed for legal, security, fraud-prevention, or backup purposes.

6.6 Feedback

If you submit suggestions or feedback, you grant us the right to use it without restriction or compensation.

7) DMCA / Copyright Complaints (Takedown Process)

If you believe content on the Service infringes your copyright, you may contact us with a notice including:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing material and where it is located
  • Your contact information
  • A statement that you have a good-faith belief the use is not authorized
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act

Contact: support@mistaketomastery.com

We may remove or disable access to the content and, where appropriate, terminate repeat infringers.

8) Our Intellectual Property

The Service, including its design, text, graphics, features, software, and all content we provide (excluding User Content), is owned by Mistake To Mastery or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from the Service or our content unless we give you written permission.

9) Educational Disclaimer (Not A Substitute for Professional Advice)

The Service is intended for educational purposes. We do not guarantee any specific exam score or outcome. Your results depend on many factors beyond our control.

10) Service Availability and Changes

We may modify, suspend, or discontinue the Service (in whole or part) at any time. We are not liable for any modification, suspension, or discontinuation.

11) Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use creates risk or legal exposure for us or other users. Upon termination, your right to use the Service ends immediately.

12) Privacy, Analytics, and Session Recording

We collect and use information to operate, secure, and improve the Service, including account information (like your email and name), the User Content you submit, basic usage and device data (like browser/device type and IP address), and support communications.

Product Analytics and Session Recording

We use third-party product analytics and session-recording tools to understand how the Service is used and to diagnose problems. These tools may record your interactions with the Service - including pages you view, clicks, navigation, scrolling, and other on-screen activity - and may capture a visual replay of the content displayed on your screen while you use the Service. These recordings are associated with your account. We do not capture your password (you sign in through Google) or your full payment card details (payments are handled in a secure frame by our payment processor). Because recordings can capture content shown on your screen, you should not enter or submit sensitive personal information into the Service (see also the User Content section).

Cookies and Similar Technologies

We and our service providers use cookies, local storage, and similar technologies to keep you signed in, remember your preferences, measure usage, and support analytics and advertising. You can control cookies through your browser settings, though some features may not work without them.

Service Providers and Advertising

We share information with service providers that help us run the Service, including a product-analytics and session-recording provider, Google (for analytics, advertising/conversion measurement, and sign-in), a payment processor, database and authentication hosting providers, an email provider, and AI providers used to generate study content. Some of this sharing - for example, advertising and conversion measurement - may be considered a “sale” or “sharing” of personal information under certain U.S. state privacy laws. These providers may store and process data outside your state or country, including in the United States.

Retention and Your Choices

We retain information for as long as needed to provide the Service and for legitimate business, legal, security, fraud-prevention, and backup purposes; session recordings are retained for a limited period and then deleted. You can request access to or deletion of your account data by contacting us at support@mistaketomastery.com, and we will take reasonable steps to honor your request, subject to legal, security, fraud-prevention, and backup retention needs.

By using the Service, you consent to the collection, use, recording, and sharing of information as described in this Section.

13) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISTAKE TO MASTERY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF YOU HAVE NOT PAID ANYTHING), WHICHEVER IS GREATER. (Some states don’t allow certain limitations; this will be applied to the extent allowed by law.)

15) Indemnification

You agree to indemnify and hold harmless Mistake To Mastery from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.

16) Dispute Resolution; Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law rules.

17) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., by posting the updated Terms and updating the Effective Date, or emailing you). Continued use of the Service after changes become effective means you accept the updated Terms.
